V tejto \u010dasti sa novela odch\u00fdlila od p\u00f4vodnej pr\u00e1vnej \u00fapravy, kedy bola oznamovacia povinnos\u0165 zamestn\u00e1vate\u013ea vo vz\u0165ahu k zamestnancovi stanoven\u00e1 na dobu 14-tich dn\u00ed vopred.&nbsp;<\/p>\n\n\n\n<p>Zmenilo sa tie\u017e nariadenie \u010derpania nevy\u010derpanej dovolenky za uplynul\u00fd rok, kedy t\u00fato m\u00f4\u017ee zamestn\u00e1vate\u013e nariadi\u0165 zamestnancovi vy\u010derpa\u0165 <strong>len s 2-d\u0148ov\u00fdm<\/strong> oznamovac\u00edm predstihom.&nbsp;<\/p>\n\n\n\n<p>V oboch pr\u00edpadoch je tak\u00e9to obdobie mo\u017en\u00e9 skr\u00e1ti\u0165 so s\u00fahlasom zamestnanca.<\/p>\n\n\n\n<p><strong>Podmienky home officu<\/strong><\/p>\n\n\n\n<p>Novelou boli zmenen\u00e9 i podmienky homeoffice &#8211; pr\u00e1ce na doma, kedy parlament rozhodol tak, \u017ee po\u010das pand\u00e9mie COVID -19:&nbsp;<\/p>\n\n\n\n<ul><li>je zamestn\u00e1vate\u013e opr\u00e1vnen\u00fd nariadi\u0165 zamestnancovi v\u00fdkon pr\u00e1ce z domu a to vtedy, ak to dohodnut\u00fd druh pr\u00e1ce umo\u017e\u0148uje,<\/li><li>S\u00fa\u010dasne zamestnanec m\u00e1 pr\u00e1vo na vykon\u00e1vanie pr\u00e1ce z domu a to op\u00e4\u0165 vtedy, ak to dohodnut\u00fd druh pr\u00e1ce umo\u017e\u0148uje a na strane zamestn\u00e1vate\u013ea nie s\u00fa v\u00e1\u017ene prev\u00e1dzkov\u00e9 d\u00f4vody, ktor\u00e9 neumo\u017e\u0148uj\u00fa v\u00fdkon pr\u00e1ce z domu.<\/li><\/ul>\n\n\n\n<p>Na rozdiel od p\u00f4vodnej \u00fapravy dnes m\u00f4\u017ee zamestn\u00e1vate\u013e home office nariadi\u0165 a nemus\u00ed k jeho realiz\u00e1cii d\u00f4js\u0165 a\u017e po dohode so zamestnancom.&nbsp;<\/p>\n\n\n\n<p><strong>N\u00e1rok na 80% n\u00e1hrady mzdy<\/strong><\/p>\n\n\n\n<p>V pr\u00edpade, \u017ee zamestnanec nem\u00f4\u017ee vykon\u00e1va\u0165 pr\u00e1cu v zmysle dohodnut\u00fdch pracovn\u00fdch podmienok (celkom alebo z \u010dasti) pre zastavenie alebo obmedzenie \u010dinnosti zamestn\u00e1vate\u013ea na z\u00e1klade rozhodnutia pr\u00edslu\u0161n\u00e9ho org\u00e1nu alebo pre zastavenie alebo obmedzenie \u010dinnosti zamestn\u00e1vate\u013ea z d\u00f4vodu vyhl\u00e1senia mimoriadnej situ\u00e1cie, n\u00fadzov\u00e9ho stavu alebo v\u00fdnimo\u010dn\u00e9ho stavu, <strong>ide o prek\u00e1\u017eku v pr\u00e1ci na strane zamestn\u00e1vate\u013ea<\/strong>. V takomto pr\u00edpade nepatr\u00ed zamestnancovi n\u00e1hrada mzdy v sume jeho priemern\u00e9ho mesa\u010dn\u00e9ho z\u00e1robku, ako pri in\u00fdch situ\u00e1ci\u00ed, ale len 80% priemern\u00e9ho z\u00e1robku, najmenej v\u0161ak v sume minim\u00e1lnej mzdy.<\/p>\n\n\n\n<p><strong>Rozvrhnutie pracovn\u00e9ho \u010dasu <\/strong><\/p>\n\n\n\n<p>Do\u0161lo tie\u017e k \u00faprave rozvrhnutia pracovn\u00e9ho \u010dasu, kedy je zamestn\u00e1vate\u013e povinn\u00fd zamestnancovi ozn\u00e1mi\u0165 rozvrhnutie pracovn\u00e9ho \u010dasu <strong>najmenej dva dni vopred<\/strong>, ak sa so zamestnancom nedohodne na krat\u0161ej dobe, a s platnos\u0165ou najmenej na 1 t\u00fd\u017ede\u0148.<\/p>\n\n\n\n<p><strong>Ospravedlnenie zamestnanca v pr\u00e1ci <\/strong><\/p>\n\n\n\n<p>Zamestn\u00e1vate\u013e ospravedln\u00ed nepr\u00edtomnos\u0165 zamestnanca v pr\u00e1ci aj po\u010das jeho d\u00f4le\u017eitej osobnej prek\u00e1\u017eky v pr\u00e1ci, ktorou je karant\u00e9nne opatrenie alebo izol\u00e1cia; za tento \u010das nepatr\u00ed zamestnancovi n\u00e1hrada mzdy, ak osobitn\u00fd predpis neustanovuje inak. <\/p>\n\n\n\n<p>Zamestnanec, ktor\u00fd m\u00e1 d\u00f4le\u017eit\u00fa osobn\u00fa prek\u00e1\u017eku v pr\u00e1ci z d\u00f4vodu karant\u00e9nneho opatrenia, izol\u00e1cie, osobn\u00e9ho a celodenn\u00e9ho o\u0161etrovania chor\u00e9ho \u010dlena rodiny pod\u013ea osobitn\u00e9ho predpisu alebo osobnej a celodennej starostlivosti o fyzick\u00fa osobu pod\u013ea osobitn\u00e9ho predpisu, sa posudzuje ako zamestnanec, ktor\u00fd je uznan\u00fd do\u010dasne za pr\u00e1ceneschopn\u00e9ho. <\/p>\n\n\n\n<p>Zamestnanec, ktor\u00fd sa vr\u00e1ti do pr\u00e1ce po skon\u010den\u00ed izol\u00e1cie, osobn\u00e9ho a celodenn\u00e9ho o\u0161etrovania chor\u00e9ho \u010dlena rodiny pod\u013ea osobitn\u00e9ho predpisu alebo osobnej a celodennej starostlivosti o fyzick\u00fa osobu pod\u013ea osobitn\u00e9ho predpisu, sa posudzuje ako zamestnanec, ktor\u00fd sa vr\u00e1ti do pr\u00e1ce po skon\u010den\u00ed do\u010dasnej pracovnej neschopnosti<\/p>\n\n\n\n<p>Odkaz: https:\/\/www.nrsr.sk\/web\/Dynamic\/DocumentPreview.aspx?DocID=477046 <\/p>\n\n\n\n<p style=\"background-color:#a1c7d7\" class=\"has-text-color has-background has-text-align-center has-very-dark-gray-color\"><strong>\u00a0Ak ste sa ocitli v nepriaznivej situ\u00e1cii sp\u00f4sobenej koronav\u00edrusom a potrebujete poskytn\u00fa\u0165 pr\u00e1vne poradenstvo v oblasti pracovn\u00e9ho\u00a0pr\u00e1va,\u00a0sme tu pre V\u00e1s.
