N\u00e1sledn\u00e9 znenie&nbsp;<strong>\u00a7 43 ods. 1 Z\u00e1konn\u00edka pr\u00e1ce<\/strong>&nbsp;uv\u00e1dza, ktor\u00e9 obsahov\u00e9 n\u00e1le\u017eitosti&nbsp;<strong><u>mus\u00ed<\/u><\/strong>&nbsp;pracovn\u00e1 zmluva obsahova\u0165.&nbsp;<\/p>\n\n\n\n<p class=\"has-cyan-bluish-gray-background-color has-background\">Zamestn\u00e1vate\u013e je povinn\u00fd sa so zamestnancom dohodn\u00fa\u0165 na:<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; a<em>) druhu pr\u00e1ce, na ktor\u00fd sa zamestnanec prij\u00edma s&nbsp;t\u00fdm, \u017ee pracovn\u00e1 zmluva mus\u00ed obsahova\u0165 aj stru\u010dn\u00fa charakteristiku \u2013 opis pr\u00e1ce,<\/em><\/p>\n\n\n\n<p><em>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; b) miesto v\u00fdkonu pr\u00e1ce (obec, \u010das\u0165 obce alebo inak ur\u010den\u00e9 miesto),<\/em><\/p>\n\n\n\n<p><em>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; c) de\u0148 n\u00e1stupu do pr\u00e1ce,<\/em><\/p>\n\n\n\n<p><em>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; d) mzdov\u00e9 podmienky, ak nie s\u00fa dohodnut\u00e9 v&nbsp;kolekt\u00edvnej zmluve.<\/em><\/p>\n\n\n\n<ol type=\"1\"><li><strong><u>Druh pr\u00e1ce, na ktor\u00fd sa zamestnanec prij\u00edma<\/u><\/strong>:<\/li><\/ol>\n\n\n\n<p>Druh pr\u00e1ce mus\u00ed by\u0165 v\u017edy ur\u010den\u00fd (formulovan\u00fd) dostato\u010dne ur\u010dito a&nbsp;z&nbsp;pracovnej zmluvy mus\u00ed by\u0165 zrejm\u00e9, \u010do je n\u00e1pl\u0148ou pr\u00e1ce zamestnanca \u2013 kr\u00e1tky popis pr\u00e1ce, ktor\u00fa bude zamestnanec pre zamestn\u00e1vate\u013ea vykon\u00e1va\u0165.&nbsp;<\/p>\n\n\n\n<p>2. <strong><u>Miesto v\u00fdkonu pr\u00e1ce:&nbsp;<\/u><\/strong><br><br>Miestom v\u00fdkonu pr\u00e1ce sa rozumie geograficky ur\u010den\u00e9 p\u00f4sobenie zamestnanca, kde bude vykon\u00e1va\u0165 pr\u00e1cu pre zamestn\u00e1vate\u013ea.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Nie je vyl\u00fa\u010den\u00e9, aby si<strong><u>&nbsp;<\/u><\/strong>zamestnanec so zamestn\u00e1vate\u013eom dohodol aj viac miest v\u00fdkonu pr\u00e1ce. Tieto av\u0161ak musia by\u0165 v\u017edy dostato\u010dne ur\u010dit\u00e9, rovnako ako ostatn\u00e9 podstatn\u00e9 n\u00e1le\u017eitosti pracovnej zmluvy.<\/p>\n\n\n\n<p>3. <strong><u>De\u0148 n\u00e1stupu do pr\u00e1ce:&nbsp;<\/u><\/strong><br><br>De\u0148 n\u00e1stupu do pr\u00e1ce je \u010fal\u0161ou z&nbsp;podstatn\u00fdch n\u00e1le\u017eitost\u00ed pracovnej zmluvy, ktor\u00e9 mus\u00ed v\u017edy obsahova\u0165. S&nbsp;d\u00e1tumom n\u00e1stupu do pr\u00e1ce sa sp\u00e1ja vznik pracovn\u00e9ho pomeru medzi zamestnancom a&nbsp;zamestn\u00e1vate\u013eom.&nbsp;<\/p>\n\n\n\n<p>Zamestnanec si so zamestn\u00e1vate\u013eom zvy\u010dajne dohaduj\u00fa ako de\u0148 n\u00e1stupu do pr\u00e1ce konkr\u00e9tny de\u0148 vyjadren\u00fd kalend\u00e1rnym d\u0148om, tento okamih v\u0161ak m\u00f4\u017ee by\u0165 vyjadren\u00fd aj in\u00fdm sp\u00f4sobom, av\u0161ak ten nesmie vzbudzova\u0165 pochybnosti o&nbsp;tom, \u010do t\u00fdm zamestnanec so zamestn\u00e1vate\u013eom chceli dohodn\u00fa\u0165. Ako de\u0148 n\u00e1stupu do pr\u00e1ce m\u00f4\u017ee by\u0165 dohodnut\u00fd aj de\u0148 pracovn\u00e9ho pokoja.<\/p>\n\n\n\n<p>4. <strong><u>Mzdov\u00e9 podmienky, ak nie s\u00fa dohodnut\u00e9 v&nbsp;kolekt\u00edvnej zmluve:<\/u><\/strong><br><br>Mzdov\u00e9 podmienky s\u00fa tie\u017e obsahovou n\u00e1le\u017eitos\u0165ou pracovnej zmluvy. M\u00f4\u017eu by\u0165 upraven\u00e9 v&nbsp;pracovnej zmluve alebo v kolekt\u00edvnej zmluve.&nbsp;<\/p>\n\n\n\n<p>POZOR!
