Po novom vydr\u017eanie u\u017e nebud\u00fa osved\u010dova\u0165 not\u00e1ri, ale v\u00fdlu\u010dne s\u00fady.<\/strong><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Vydr\u017eanie je v&nbsp;skratke sp\u00f4sob nadobudnutia vlastn\u00edckeho pr\u00e1va k&nbsp;hnute\u013en\u00fdm i&nbsp;nehnute\u013en\u00fdm veciam (stavby, pozemky). Z\u00e1kladnou podmienkou pre \u00faspe\u0161n\u00e9 vydr\u017eanie vlastn\u00edckeho pr\u00e1va k nehnute\u013enosti je nepretr\u017eit\u00e1 dr\u017eba (u\u017e\u00edvanie) predmetnej nehnute\u013enosti po dobu najmenej 10 rokov a z\u00e1rove\u0148 dobromyse\u013en\u00e1 dr\u017eba veci, \u010do znamen\u00e1, \u017ee so zrete\u013eom na v\u0161etky okolnosti mus\u00ed by\u0165 dr\u017eite\u013e dobromyse\u013en\u00fd&nbsp;v tom, \u017ee mu vec patr\u00ed.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Od 01.05.2021 nadobudne \u00fa\u010dinnos\u0165 novela z\u00e1kona, ktor\u00e1 zav\u00e1dza \u00faplne nov\u00fd syst\u00e9m potvrdenia vydr\u017eania. Doteraz bolo vydr\u017eanie osved\u010dovan\u00e9 len not\u00e1rom. N\u00e1sledne mohol nov\u00fd vlastn\u00edk osved\u010den\u00e9 vyhl\u00e1senie o&nbsp;vydr\u017ean\u00ed predlo\u017ei\u0165 katastru nehnute\u013enost\u00ed, ktor\u00fd nadobudnutie vlastn\u00edctva nov\u00fdm vlastn\u00edkom zap\u00edsal. V&nbsp;praxi sa tak mohlo sta\u0165, \u017ee osved\u010den\u00edm vyhl\u00e1senia o&nbsp;vydr\u017ean\u00ed nadobudol nov\u00fd vlastn\u00edk vec bez vedomosti p\u00f4vodn\u00e9ho vlastn\u00edka. Novelou z\u00e1kona bolo rozhodnut\u00e9, \u017ee o vydr\u017ean\u00ed nehnute\u013enosti bude v\u017edy rozhodova\u0165 s\u00fad.&nbsp;<\/p>\n\n\n\n<p>Tzv. konanie o&nbsp;potvrden\u00ed vydr\u017eania s\u00fadom bude za\u010d\u00edna\u0165 v\u017edy na n\u00e1vrh tej osoby, ktor\u00e1 tvrd\u00ed, \u017ee vydr\u017ean\u00edm nadobudla vlastn\u00edcke pr\u00e1vo k&nbsp;nehnute\u013enosti. S\u00fad prizn\u00e1 postavenie \u00fa\u010dastn\u00edkov konania osob\u00e1m, ktor\u00e9 maj\u00fa k&nbsp;predmetnej nehnute\u013enosti zap\u00edsan\u00e9 na liste vlastn\u00edctva vlastn\u00edcke pr\u00e1vo. \u00da\u010dastn\u00edkom konania m\u00f4\u017eu by\u0165 takisto spr\u00e1vca lesn\u00e9ho pozemku (LESY SR, \u0161.p.) a&nbsp;Slovensk\u00fd pozemkov\u00fd fond (SPF). S\u00fad pos\u00fadi n\u00e1vrh na potvrdenie o&nbsp;vydr\u017ean\u00ed a&nbsp;pokia\u013e tento n\u00e1vrh v\u0161etky n\u00e1le\u017eitosti sp\u013a\u0148a, vyd\u00e1 vyz\u00fdvacie uznesenie, v&nbsp;ktorom vyzve vlastn\u00edkov zap\u00edsan\u00fdch na liste vlastn\u00edctva, aby uplatnili svoje n\u00e1mietky k&nbsp;vydr\u017eaniu. Dotknut\u00e9 osoby musia poda\u0165 n\u00e1mietky v\u010das (v ur\u010denej lehote) a&nbsp;musia od\u00f4vodni\u0165 pre\u010do si myslia, \u017ee nedo\u0161lo k&nbsp;nadobudnutiu vlastn\u00edckeho pr\u00e1va vydr\u017ean\u00edm, pr\u00edp. uvies\u0165 in\u00e9 d\u00f4vody pre ktor\u00e9 by s\u00fad nemal potvrdi\u0165 vydr\u017eanie. S\u00fad n\u00e1mietky dotknut\u00fdch os\u00f4b pos\u00fadi a&nbsp;rozhodne o&nbsp;potvrden\u00ed alebo nepotvrden\u00ed vydr\u017eania.
