Jedn\u00fdm z&nbsp;t\u00fdchto sp\u00f4sobov je uzatvorenie Dohody o vyporiadan\u00ed BSM.<\/p>\n\n\n\n<p class=\"has-cyan-bluish-gray-background-color has-background\"><em>Forma Dohody o&nbsp;vyporiadan\u00ed BSM<\/em><em><\/em><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Dohodu o&nbsp;vyporiadan\u00ed BSM m\u00f4\u017eete <strong>uzavrie\u0165 v&nbsp;akejko\u013evek forme, a to tak v \u00fastnej, p\u00edsomnej ako aj konkludentnej<\/strong>.&nbsp;P\u00edsomn\u00e1 forma tejto Dohody sa vy\u017eaduje len v&nbsp;pr\u00edpade, \u017ee je jej predmetom nehnute\u013enos\u0165. Z d\u00f4vodu pr\u00e1vnej istoty v\u0161ak odpor\u00fa\u010dame klientom uzatvori\u0165 v\u0161etky Dohody t\u00fdkaj\u00face sa vyporiadania BSM p\u00edsomnou formou, aby nesk\u00f4r nevznikali zbyto\u010dn\u00e9&nbsp;konflikty a strety z\u00e1ujmov medzi b\u00fdval\u00fdmi man\u017eelmi a aby nedo\u0161lo k d\u00f4kaznej n\u00fadzi pri preukazovan\u00ed obsahu uzatvorenej Dohody o vyporiadan\u00ed BSM.&nbsp;<\/p>\n\n\n\n<p class=\"has-cyan-bluish-gray-background-color has-background\"><em>Lehota na podp\u00edsanie&nbsp;<\/em><em>Dohody o&nbsp;vyporiadan\u00ed BSM<\/em><em><\/em><\/p>\n\n\n\n<p><em>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/em><strong>Dohodu o vyporiadan\u00ed BSM je mo\u017en<\/strong><strong>\u00e9&nbsp;<\/strong><strong>medzi b\u00fdval\u00fd<\/strong><strong>mi man<\/strong><strong>\u017eelmi uzatvori\u0165 a\u017e po z\u00e1niku man\u017eelstva a najnesk\u00f4r&nbsp;<\/strong><strong>do&nbsp;<\/strong><strong>3-och rokov od pr\u00e1voplatnosti rozsudku o rozvode man\u017eelstva.&nbsp;<\/strong><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Dohoda o vyporiadan\u00ed BSM uzatvoren\u00e1 pred z\u00e1nikom man\u017eelstva by bola v zmysle ustanovenia \u00a7 39 Ob\u010dianskeho z\u00e1konn\u00edka pova\u017eovan\u00e1&nbsp;za absol\u00fatne neplatn\u00fa. Tak\u00fato Dohodu pred z\u00e1nikom man\u017eelstva nem\u00f4\u017eete&nbsp;uzatvori\u0165 ani s pr\u00edpadnou odkladacou podmienkou v zmysle zau\u017e\u00edvanej s\u00fadnej praxe.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Rovnako by bola neplatn\u00e1 i Dohoda o vyporiadan\u00ed BSM uzatvoren\u00e1 po uplynut\u00ed troch rokov odo d\u0148a pr\u00e1voplatnosti rozsudku o rozvode man\u017eelstva, pri\u010dom v takomto pr\u00edpade je potrebn\u00e9&nbsp;postupova\u0165 pod\u013ea \u00a7149 ods. 4 Ob\u010dianskeho z\u00e1konn\u00edka. Po uplynut\u00ed troch rokov je pr\u00edpustn\u00e9&nbsp;len vyporiadanie formou s\u00fadom schv\u00e1len\u00e9ho zmieru medzi \u00fa\u010dastn\u00edkmi.<em><\/em><\/p>\n\n\n\n<p class=\"has-cyan-bluish-gray-background-color has-background\"><em>Obsah a&nbsp;rozsah Dohody o&nbsp;vyporiadan\u00ed BSM<\/em><em><\/em><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;V zmysle ustanovenia&nbsp;\u00a7 150 Ob\u010dianskeho z\u00e1konn\u00edka: \u201c<strong><em>Pri vyporiadan\u00ed sa vych\u00e1dza z toho, \u017ee podiely oboch man\u017eelov s\u00fa rovnak<\/em><\/strong><strong><em>\u00e9<\/em><\/strong><strong><em>.<\/em><\/strong><em>&nbsp;Ka\u017ed\u00fd&nbsp;<\/em><em>z man<\/em><em>\u017eelov je opr\u00e1vnen\u00fd po\u017eadova\u0165, aby sa mu uhradilo, \u010do zo svojho vynalo\u017eil na spolo\u010dn\u00fd majetok, a je povinn\u00fd nahradi\u0165, \u010do sa zo spolo\u010dn<\/em><em>\u00e9<\/em><em>ho majetku vynalo\u017eilo na jeho ostatn\u00fd majetok. \u010ealej sa prihliadne predov\u0161etk\u00fdm na potreby malolet\u00fd<\/em><em>ch det<\/em><em>\u00ed, na to, ako sa ka\u017ed\u00fd&nbsp;<\/em><em>z man<\/em><em>\u017eelov staral o rodinu, a na to, ako sa zasl\u00fa\u017eil o nadobudnutie a udr\u017eanie spolo\u010dn\u00fdch vec\u00ed. Pri ur\u010den\u00ed&nbsp;<\/em><em>miery pri<\/em><em>\u010dinenia treba vzia\u0165&nbsp;<\/em><em>tie<\/em><em>\u017e zrete\u013e na&nbsp;<\/em><em><a href=\"https:\/\/ficek.sk\/starostlivost-o-deti-21684\">starostlivos\u0165&nbsp;o deti<\/a><\/em><em>&nbsp;a na obstar\u00e1vanie spolo\u010dnej dom\u00e1cnosti.\u201d&nbsp;<\/em><em><\/em><\/p>\n\n\n\n<p><em>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/em>Pri vyporiadan\u00ed BSM je potrebn\u00e9&nbsp;postupova\u0165 v s\u00falade so z\u00e1sadami obsiahnut\u00fdmi vo vy\u0161\u0161ie citovanom z\u00e1konnom ustanoven\u00ed. V pr\u00edpade, \u017ee by sa strany od t\u00fdchto z\u00e1sad pri spisovan\u00ed a uzatv\u00e1ran\u00ed Dohody o vyporiadan\u00ed BSM odch\u00fdlili, poru\u0161ili by ustanovenie \u00a7 39 Ob\u010dianskeho z\u00e1kona, kedy ka\u017ed\u00fd&nbsp;pr\u00e1vny \u00fakon za \u00fa\u010delom jeho platnosti mus\u00ed by\u0165 spraven\u00fd v&nbsp;s\u00falade s&nbsp;dobr\u00fdmi mravmi. N\u00e1sledkom poru\u0161enia dobr\u00fdch mravov by bola absol\u00fatna neplatnos\u0165 takejto Dohody.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;\u010co sa t\u00fdka rozsahu Dohody o vyporiadan\u00ed BSM, tak tu n\u00e1jdeme rozli\u010dn\u00fa judikat\u00farnu l\u00edniu. Niektor\u00e9&nbsp;s\u00fadne rozhodnutia, napr\u00edklad rozhodnutie NSSR, sp. zn. 2 Cdo 83\/1998 uv\u00e1dza, \u017ee: \u201e<em>Dohoda o vyporiadan\u00ed bezpodielov<\/em><em>\u00e9<\/em><em>ho spoluvlastn\u00edctva man\u017eelov sa mus\u00ed t\u00fdka\u0165 v\u0161etk<\/em><em>\u00e9<\/em><em>ho majetku tvoriaceho bezpodielov<\/em><em>\u00e9&nbsp;<\/em><em>spoluvlastn\u00edctvo, ktor\u00fd existoval v \u010dase z\u00e1niku tohto spoluvlastn\u00edctva<\/em>.\u201c I napriek tomu, \u017ee je toto rozhodnutie e\u0161te z roku 1998 nejedn\u00e1 sa o&nbsp;prekonan\u00fd postoj k danej problematike. Obdobn\u00fd n\u00e1zor zaujal aj NSSR v rozhodnut\u00ed, sp. zn. 2 M Cdo 5\/2008, ke\u010f uviedol: \u201e<em>Cie\u013eom vyporiadania bezpodielov<\/em><em>\u00e9<\/em><em>ho spoluvlastn\u00edctva man\u017eelov je vyporiadanie cel<\/em><em>\u00e9<\/em><em>ho spolo\u010dn<\/em><em>\u00e9<\/em><em>ho majetku man\u017eelov, ktor\u00fd pod\u013ea \u00a7 143 OZ patril do bezpodielov<\/em><em>\u00e9<\/em><em>ho spoluvlastn\u00edctva d\u0148u z\u00e1niku man\u017eelstva. Dohoda iba o \u010dasti bezpodielov<\/em><em>\u00e9<\/em><em>ho spoluvlastn\u00edctva by pri s\u00fadnom vyporiadan\u00ed znemo\u017enila komplexne usporiada\u0165 majetkov<\/em><em>\u00e9&nbsp;<\/em><em>vz\u0165ahy medzi man\u017eelmi so zrete\u013eom ku v\u0161etk\u00fdm h\u013eadisk\u00e1m obsiahnut\u00fdm v z\u00e1sad\u00e1ch uveden\u00fdch v \u00a7 149 v spojen\u00ed s \u00a7 150 OZ. S\u00fa<\/em><em>d mus<\/em><em>\u00ed pri vyporiadan\u00ed bezpodielov<\/em><em>\u00e9<\/em><em>ho spoluvlastn\u00edctva man\u017eelov zoh\u013eadni\u0165 v\u0161etok majetok existuj\u00faci ku d\u0148u jeho z\u00e1niku, aj ke\u010f sa oh\u013eadne neho \u00fa\u010dastn\u00edci u\u017e dohodli a rozdelili si ho<\/em>.\u201c<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Ako sme u\u017e vy\u0161\u0161ie uviedli t\u00e1to problematika je \u017eivnou p\u00f4dou viacer\u00fdch odborn\u00fdch diskusi\u00ed. V praxi sa stret\u00e1vame i s protichodn\u00fdm n\u00e1zorom a teda, \u017ee je potrebn\u00e9&nbsp;vo veci postupova\u0165 s poukazom na princ\u00edp zmluvnej auton\u00f3mie, kedy je d\u00f4vodn\u00e9&nbsp;za platn\u00e9&nbsp;uzavretie Dohody o vyporiadan\u00ed BSM pova\u017eova\u0165 i jej \u010diasto\u010dn\u00e9&nbsp;uzatvorenie. Teda uzatvorenie Dohody o vyporiadan\u00ed BSM, ktorej obsahom nebude tzv. cel\u00e1 masa BSM. Uveden\u00e9mu sa venoval aj NSSR v rozhodnut\u00ed, sp. zn. 4 Cdo 147\/2011, ktor\u00fd uviedol, \u017ee \u201e<strong><em>je potrebn<\/em><\/strong><strong><em>\u00e9&nbsp;<\/em><\/strong><strong><em>re\u0161pektova\u0165 v\u00f4\u013eu str\u00e1n, ktor<\/em><\/strong><strong><em>\u00e9&nbsp;<\/em><\/strong><strong><em>s\u00fa ochotn<\/em><\/strong><strong><em>\u00e9&nbsp;<\/em><\/strong><strong><em>uzavrie\u0165 dohodu t\u00fdkaj\u00facu sa aj vyporiadania jednotliv\u00fdch vec\u00ed<\/em><\/strong><strong><em>, resp.&nbsp;<\/em><\/strong><strong><em>\u010dasti majetku patriaceho do bezpodielov<\/em><\/strong><strong><em>\u00e9<\/em><\/strong><strong><em>ho spoluvlastn\u00edctva man\u017eelov.&nbsp;<\/em><\/strong><em>Preto dohoda o vyporiadan\u00ed bezpodielov<\/em><em>\u00e9<\/em><em>ho spoluvlastn\u00edctva man\u017eelov, ktor\u00e1 sa net\u00fdka cel<\/em><em>\u00e9<\/em><em>ho majetku, ktor\u00fd bol v bezpodielovom spoluvlastn\u00edctve, nie je neplatn\u00e1.<\/em>\u201c<\/p>\n\n\n\n<p class=\"has-cyan-bluish-gray-background-color has-background\"><strong>In\u0161tit\u00fat K\u00fapnej zmluvy namiesto Dohody o vyporiadan\u00ed BSM?<\/strong><strong><em><\/em><\/strong><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Vo svojej praxi sa&nbsp;\u010dasto stret\u00e1vame aj s ot\u00e1zkou \u010di je mo\u017en\u00e9&nbsp;namiesto Dohody o vyporiadan\u00ed BSM uzatvori\u0165 medzi b\u00fdval\u00fdmi man\u017eelmi K\u00fapnu zmluvu a t\u00fato ako podklad prevodu vlastn\u00edckeho pr\u00e1va doru\u010di\u0165 katastru nehnute\u013enost\u00ed&nbsp;za&nbsp;\u00fa\u010delom jeho prevodu.&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Odpove\u010f znie NIE.&nbsp;Pokia\u013e budeme vych\u00e1dza\u0165 zo z\u00e1konn\u00fdch ustanoven\u00ed Ob\u010dianskeho z\u00e1konn\u00edka a s\u00fa\u010dasne prihliadneme na podstatu BSM je tak\u00e1to mo\u017enos\u0165 v rozpore s platn\u00fdm pr\u00e1vnym poriadkom. Za predpokladu, \u017ee by b\u00fdval\u00ed man\u017eelia skuto\u010dne uskuto\u010dnili prevod vlastn\u00edckeho pr\u00e1va&nbsp;k nehnute\u013enosti patriacej do BSM K\u00fapnou zmluvou, do\u0161lo by z ich strany k obch\u00e1dzaniu z\u00e1konn\u00fdch ustanoven\u00ed a v\u00fdsledkom ich konania by bola&nbsp;neplatn\u00e1 zmluva.&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Kataster nehnute\u013enost\u00ed m\u00e1 toti\u017eto povinnos\u0165 pri zavkladovan\u00ed vlastn\u00edckeho pr\u00e1va k nehnute\u013enosti sk\u00fama\u0165, \u010di zmluva (a teda aj dohoda o vyporiadan\u00ed BSM \u010di k\u00fapna zmluva) neodporuje z\u00e1konu alebo ho neobch\u00e1dza.&nbsp;<\/p>\n\n\n\n<p class=\"has-cyan-bluish-gray-background-color has-background\"><strong>Ak\u00fdm sp\u00f4sobom d\u00f4jde k zmene vlastn\u00edckeho pr\u00e1va v katastri?<\/strong><strong><\/strong><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Dohoda o vyporiadan\u00ed BSM je sp\u00f4sobil\u00fdm titulom na zmenu vlastn\u00edckeho pr\u00e1va k nehnute\u013enosti patriacej do BSM v katastri nehnute\u013enost\u00ed. Na z\u00e1klade takejto Dohody kataster nehnute\u013enost\u00ed prist\u00fapi k zmene vlastn\u00edckeho pr\u00e1va, pri\u010dom sk\u00fama&nbsp;<strong>\u010di Dohoda sp\u013a\u0148a v\u0161eobecn<\/strong><strong>\u00e9&nbsp;<\/strong><strong>n\u00e1le\u017eitosti a \u010di s\u00fa podpiy oboch b\u00fdval\u00fd<\/strong><strong>ch man<\/strong><strong>\u017eelov na Dohode o vyporiadan\u00ed BSM \u00faradne overen<\/strong><strong>\u00e9<\/strong><strong>.<\/strong><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;V zmysle ustanovenia&nbsp;\u00a7 31 ods. 1 Z\u00e1kona o katastri nehnute\u013enost\u00ed: \u201c<em>Okresn\u00fd \u00farad presk\u00fama zmluvu z h\u013eadiska, \u010di obsahuje podstatn<\/em><em>\u00e9&nbsp;<\/em><em>n\u00e1le\u017eitosti zmluvy, \u010di je \u00fakon uroben\u00fd v predp\u00edsanej forme, \u010di je prevodca opr\u00e1vnen\u00fd naklada\u0165 s nehnute\u013e<\/em><em>nos<\/em><em>\u0165ou, \u010di s\u00fa prejavy v\u00f4le dostato\u010dne ur\u010dit<\/em><em>\u00e9&nbsp;<\/em><em>a zrozumite\u013en<\/em><em>\u00e9<\/em><em>, \u010di zmluvn\u00e1 vo\u013e<\/em><em>nos<\/em><em>\u0165 alebo pr\u00e1vo naklada\u0165 s nehnute\u013e<\/em><em>nos<\/em><em>\u0165ou nie s\u00fa obmedzen<\/em><em>\u00e9<\/em><em>,&nbsp;<strong>\u010di zmluva neodporuje z\u00e1konu, \u010di z\u00e1kon neobch\u00e1dza a \u010di sa neprie\u010di dobr\u00fdm mravom<\/strong>. Pri rozhodovan\u00ed o vklade prihliada okresn\u00fd \u00farad aj na skutkov<\/em><em>\u00e9&nbsp;<\/em><em>a pr\u00e1vne skuto\u010dnosti,&nbsp;ktor<\/em><em>\u00e9&nbsp;<\/em><em>by mohli ma\u0165 vplyv na povolenie vkladu.\u201d<\/em><\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;V zmysle ustanovenia&nbsp;\u00a7 42 ods. 3 Z\u00e1kona o katastri nehnute\u013enost\u00ed: \u201c<em>Podpis prevodcu na zmluve, podpis povinn<\/em><em>\u00e9<\/em><em>ho z predkupn<\/em><em>\u00e9<\/em><em>ho pr\u00e1va, podpis povinn<\/em><em>\u00e9<\/em><em>ho v pr\u00edpade vzniku vecn<\/em><em>\u00e9<\/em><em>ho bremena alebo podpis opr\u00e1vnen<\/em><em>\u00e9<\/em><em>ho v pr\u00edpade z\u00e1niku vecn<\/em><em>\u00e9<\/em><em>ho bremena na zmluve,&nbsp;<strong>podpisy spoluvlastn\u00edkov<\/strong>&nbsp;na zmluve o zru\u0161en\u00ed a vyporiadan\u00ed podielov<\/em><em>\u00e9<\/em><em>ho spoluvlastn\u00edctva&nbsp;<strong>alebo pri vyporiadan\u00ed bezpodielov<\/strong><\/em><strong><em>\u00e9<\/em><\/strong><strong><em>ho spoluvlastn\u00edctva man\u017eelov musia by\u0165 osved\u010den<\/em><\/strong><strong><em>\u00e9&nbsp;<\/em><\/strong><strong><em>pod\u013ea osobitn\u00fdch predpisov<\/em><\/strong><em>;10a) ak s\u00fa tieto osoby zast\u00fapen<\/em><em>\u00e9<\/em><em>, ich podpis na splnomocnen\u00ed mus\u00ed by\u0165&nbsp;<\/em><em>tie<\/em><em>\u017e osved\u010den\u00fd. To neplat\u00ed, ak je \u00fa\u010dastn\u00edkom zmluvy \u0161t\u00e1tny org\u00e1<\/em><em>n, Fond n<\/em><em>\u00e1rodn<\/em><em>\u00e9<\/em><em>ho majetku Slovenskej republiky, Slovensk\u00fd pozemkov\u00fd fond, obec alebo vy\u0161\u0161\u00ed \u00fazemn\u00fd celok alebo ak ide o zmluvu o prevode nehnute\u013enosti vyhotoven\u00fa&nbsp;<\/em><em>vo forme not<\/em><em>\u00e1rskej z\u00e1pisnice alebo autorizovan\u00fa advok\u00e1tom.\u201d<\/em><em><\/em><\/p>\n\n\n\n<p class=\"has-text-align-center has-background\" style=\"background-color:#7fabbd\"><strong>V&nbsp;oblasti&nbsp;rodinn\u00e9ho&nbsp;pr\u00e1va&nbsp;sa&nbsp; \u0161pecializujeme&nbsp;okrem&nbsp;in\u00e9ho&nbsp; aj&nbsp;na&nbsp;rozvody a \u00fapravu styku rodi\u010dov k&nbsp;malolet\u00fdm de\u0165om a ur\u010denie vy\u017eivovacej povinnosti. V tak\u00fdchto pr\u00edpadoch poskytneme klientovi kvalifikovan\u00e9&nbsp;pr\u00e1vne poradenstvo a profesion\u00e1lny pr\u00edstup rovnako aj pomoc a s\u00fa\u010dinnos\u0165 pri rie\u0161en\u00ed jeho individu\u00e1lneho probl\u00e9mu.
