V&nbsp;praxi vznik\u00e1 \u010dast\u00e1 situ\u00e1cia, ke\u010f spoluvlastn\u00edk prev\u00e1dza len \u010das\u0165 jeho spoluvlastn\u00edckeho podielu na in\u00e9ho spoluvlastn\u00edka, av\u0161ak na pozemku ost\u00e1va zvy\u0161n\u00e1 \u010das\u0165 spoluvlastn\u00edckeho podielu. Najvy\u0161\u0161\u00ed s\u00fad SR k&nbsp;t\u00fdmto pr\u00edpadom na jese\u0148 2022 judikoval, \u017ee tak\u00fdto prevod spoluvlastn\u00edckeho podielu je v&nbsp;rozpore so z\u00e1kazom drobenia pozemkov<\/p>\n\n\n\n<p>Pod\u013ea n\u00e1zoru Najvy\u0161\u0161ieho s\u00fadu SR&nbsp;bolo cie\u013eom z\u00e1konodarcu dan\u00fdmi obmedzeniami eliminova\u0165 rozdrobenos\u0165 po\u013enohospod\u00e1rskych pozemkov, a preto nie je mo\u017en\u00e9 pripusti\u0165 in\u00fd z\u00e1ver ne\u017e ten, \u017ee&nbsp;spoluvlastn\u00edcky podiel prevodcu mus\u00ed zanikn\u00fa\u0165 (respekt\u00edve prejs\u0165 na in\u00e9ho spoluvlastn\u00edka) ako celok, v d\u00f4sledku \u010doho sa vlastn\u00edctvo k dotknut\u00e9mu po\u013enohospod\u00e1rskemu pozemku nebude \u010falej drobi\u0165, ale pr\u00e1ve naopak sa scel\u00ed v d\u00f4sledku zmen\u0161enia po\u010dtu spoluvlastn\u00edkov, \u010do je rovnako naplnen\u00edm cie\u013ea z\u00e1konodarcu. (vi\u010f.&nbsp;<a href=\"https:\/\/www.epi.sk\/form\/goto.ashx?t=27&amp;p=2252704&amp;f=3\">\u00a7 24 ods. 1 druh\u00e1 veta z\u00e1kona \u010d. 180\/1995 Z. z.<\/a>)<\/p>\n\n\n\n<p>Pod\u013ea spom\u00ednan\u00e9ho&nbsp;<a href=\"https:\/\/www.nsud.sk\/rozhodnutia\/5szrk62020\/\">rozhodnutia<\/a>&nbsp;Najvy\u0161\u0161ieho s\u00fadu SR je bez pr\u00e1vneho v\u00fdznamu, \u017ee tak\u00fdm prevodom nedoch\u00e1dza k nav\u00fd\u0161eniu po\u010dtu spoluvlastn\u00edkov a ani k extr\u00e9mnym zlomkov\u00fdm vyjadreniam spoluvlastn\u00edckych podielov, resp. znormalizovaniu jestvuj\u00facich podielov. Pod\u013ea n\u00e1zoru Najvy\u0161\u0161ieho s\u00fadu SR k drobeniu takto d\u00f4jde u\u017e jednoducho z d\u00f4vodu zmen\u0161enia existuj\u00faceho spoluvlastn\u00edckeho podielu, ktor\u00fd by po rozdelen\u00ed nedosahoval po\u017eadovan\u00fd rozsah v\u00fdmery 2.000 m<sup>2<\/sup>, pod\u013ea nov\u0161ieho z\u00e1kona 3.000 m<sup>2<\/sup>, a preto by sa v takom pr\u00edpade jednalo len o \u010fal\u0161ie drobenie pozemku. Na uvedenom ni\u010d nemen\u00ed ani skuto\u010dnos\u0165, \u017ee sa v tomto konkr\u00e9tnom pr\u00edpade nejedn\u00e1 o extr\u00e9mne zlomkov\u00e9 vyjadrenie spoluvlastn\u00edckeho podielu. Pr\u00e1ve naopak, ak by bol pr\u00edpustn\u00fd in\u00fd v\u00fdklad, ni\u010d nebr\u00e1nilo drobeniu po\u013enohospod\u00e1rskych pozemkov medzi spoluvlastn\u00edkmi na nezmyselne mal\u00e9 spoluvlastn\u00edcke podiely, \u010do je celkom v rozpore so z\u00e1kazom drobenia.
